Terms of Service

Welcome to BridgeDays. These Terms of Service ("Terms") govern your access to and use of the BridgeDays mobile application (the "App") and any related services provided by us ("BridgeDays", "we", "us", or "our").

By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree, please uninstall the App and discontinue use immediately. These Terms form a legally binding agreement between you and BridgeDays.

1. Acceptance of Terms

By accessing or using BridgeDays you confirm that:

• You are at least 13 years of age (or 16 in the EEA/UK).
• If you are between 13 and 18, you have obtained parental or guardian consent.
• You have read and understood these Terms and our Privacy Policy.
• You agree to comply with all applicable local, national, and international laws and regulations.

2. Licence to Use the App

Subject to your compliance with these Terms, BridgeDays grants you a limited, non-exclusive, non-transferable, revocable licence to download and use the App on a device you own or control, solely for your personal, non-commercial purposes.

This licence does not include the right to:

• Copy, modify, or create derivative works of the App or its content.
• Reverse engineer, decompile, disassemble, or attempt to derive the App's source code.
• Sublicense, sell, rent, lease, transfer, or distribute the App to any third party.
• Remove or alter any proprietary notices, labels, or branding within the App.

3. User Accounts

To access certain features you must create an account. You agree to:

• Provide accurate, current, and complete information during registration.
• Maintain the security of your password and immediately notify us of any unauthorised use.
• Accept responsibility for all activities that occur under your account.
• Not share your account credentials with any third party.

We reserve the right to suspend or terminate your account if we reasonably believe you have violated these Terms.

4. Premium Subscription

4.1 Subscription Plans

BridgeDays offers the following Premium subscription options:

• Monthly Plan: $3.99 USD per month.
• Annual Plan: $29.99 USD per year (approximately 48% savings vs. monthly billing).

Prices are displayed in US Dollars and may vary by region due to local currency conversion or applicable taxes. The current price is shown at the point of purchase within the App.

4.2 Billing and Auto-Renewal

Premium subscriptions are billed through your Apple App Store or Google Play Store account. Subscriptions automatically renew at the end of each billing period unless cancelled at least 24 hours before the end of the current period. Your account will be charged for renewal within 24 hours prior to the end of the current period at the same rate as your current plan.

4.3 Free Trial

We may, at our discretion, offer a free trial period for Premium. If a free trial is offered, you will not be charged until the trial period ends. Cancellation before the trial ends will prevent any charge.

4.4 Cancellation

You may cancel your subscription at any time through:

• iOS: Settings → [Your Name] → Subscriptions → BridgeDays → Cancel Subscription.
• Android: Google Play Store → Menu → Subscriptions → BridgeDays → Cancel.

Cancellation takes effect at the end of the current billing period. You retain access to Premium features until the end of the paid period. We do not issue refunds for unused portions of a subscription period, except as required by applicable law.

4.5 Price Changes

We reserve the right to change subscription prices at any time. We will provide at least 30 days' notice of any price change. Continued use of the App after the effective date of a price change constitutes acceptance of the new price.

4.6 Refunds

All purchases are final and non-refundable, except as required by law. For refund requests on the App Store, please contact Apple Support. For Google Play, please contact Google Play Support. We do not have the ability to process refunds directly for store purchases.

5. User Content

The App allows you to create content such as trip plans, notes, and destination lists ("User Content"). You retain ownership of your User Content. By submitting User Content, you grant BridgeDays a worldwide, non-exclusive, royalty-free licence to store and display your User Content solely for the purpose of operating and improving the App.

You represent and warrant that your User Content does not:

• Infringe any third-party intellectual property, privacy, or publicity rights.
• Contain unlawful, defamatory, obscene, or harmful material.
• Violate any applicable law or regulation.

6. Prohibited Uses

You agree not to use the App to:

• Engage in any activity that is illegal, harmful, fraudulent, or deceptive.
• Harass, abuse, threaten, or intimidate any person.
• Upload or transmit viruses, malware, or any other malicious code.
• Attempt to gain unauthorised access to any part of the App, servers, or networks.
• Use automated tools (bots, scrapers, crawlers) to access or collect data from the App.
• Interfere with or disrupt the integrity or performance of the App or its servers.
• Circumvent any content-filtering or access-control mechanisms.
• Impersonate any person or entity, or falsely represent your affiliation with any person or entity.
• Use the App for any commercial purpose not expressly authorised by these Terms.

7. Holiday Data & Accuracy

Holiday and public event data provided through the App is sourced from reputable public databases and updated regularly. However, we do not guarantee the accuracy, completeness, or timeliness of this data. Public holiday dates can change due to government proclamations or corrections. Always verify important dates with official local government sources before making travel bookings or business decisions.

8. Intellectual Property

The App and all its contents — including but not limited to the BridgeDays name, logo, design, text, graphics, software, and source code — are owned by BridgeDays or its licensors and are protected by applicable intellectual property laws, including copyright, trademark, and trade secret laws. You may not use our trademarks, logos, or branding without our prior written consent.

9. Third-Party Services

The App integrates with third-party services including Google Firebase, Google AdMob, and Apple and Google app store platforms. Your use of these services is subject to their respective terms of service and privacy policies. We are not responsible for the practices or content of any third-party service.

10. Disclaimers

THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR UNINTERRUPTED OR ERROR-FREE OPERATION.

WE DO NOT WARRANT THAT (A) THE APP WILL MEET YOUR REQUIREMENTS; (B) THE APP WILL BE AVAILABLE AT ANY PARTICULAR TIME OR LOCATION, UNINTERRUPTED OR SECURE; (C) ANY DEFECTS OR ERRORS WILL BE CORRECTED; OR (D) THE INFORMATION AND DATA PROVIDED IS ACCURATE OR COMPLETE.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, BRIDGEDAYS AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE APP OR THESE TERMS, WHETHER BASED ON CONTRACT, TORT, STRICT LIABILITY, OR ANY OTHER THEORY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL CUMULATIVE LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATING TO THESE TERMS OR THE APP SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) $10 USD.

Some jurisdictions do not allow the exclusion of certain warranties or limitations of liability, so some of the above limitations may not apply to you.

12. Indemnification

You agree to indemnify, defend, and hold harmless BridgeDays and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or in connection with: (a) your use of the App; (b) your User Content; (c) your violation of these Terms; or (d) your violation of any third-party rights.

13. Termination

We reserve the right to suspend or terminate your access to the App at any time, with or without notice, for any reason, including but not limited to breach of these Terms. Upon termination, your licence to use the App immediately ceases. Sections 8 (Intellectual Property), 10 (Disclaimers), 11 (Limitation of Liability), 12 (Indemnification), and 14 (Governing Law) survive termination.

You may delete your account at any time through the App's Settings screen. Account deletion will result in the permanent removal of your profile data and User Content, subject to our data retention obligations.

14. Governing Law & Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the jurisdiction in which BridgeDays operates, without regard to its conflict of law provisions. Any dispute arising under these Terms shall first be attempted to be resolved through good-faith negotiation. If unresolved within 30 days, disputes shall be submitted to binding arbitration or the competent courts of the applicable jurisdiction.

If you are a consumer in the European Union, you may have access to the EU Online Dispute Resolution platform at ec.europa.eu/odr.

15. Changes to These Terms

We may modify these Terms at any time. We will notify you of material changes by updating the "Last updated" date above and, where appropriate, by in-app notification or email. Your continued use of the App after the effective date of the updated Terms constitutes your acceptance. If you disagree with any changes, please stop using the App and delete your account.

16. Severability & Waiver

If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect. Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.

17. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and BridgeDays with respect to the App and supersede all prior agreements, representations, and understandings.
